Agreement to Terms

By accessing or using the services provided by Borje Web Design ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

Services

Borje Web Design provides web design, web development, and related digital services for businesses. Our services include but are not limited to:

• Custom website design and development
• Website hosting and maintenance
• Search engine optimization (SEO)
• Google Ads management
• AI integration and chatbot development

Project Terms

All projects are governed by a separate project proposal or agreement that outlines specific deliverables, timelines, and pricing. The project proposal, once accepted, becomes part of these Terms of Service.

• Projects begin upon receipt of the agreed deposit
• Timelines are estimates and may vary based on client responsiveness and project scope
• Additional requests outside the original scope may incur additional charges
• We reserve the right to showcase completed work in our portfolio unless otherwise agreed

Payment Terms

Payment terms are outlined in your project proposal. General terms include:

• A deposit is required before work begins (typically 50%)
• Final payment is due upon project completion, before site launch
• Monthly services (hosting, maintenance) are billed in advance
• Late payments may result in service suspension
• All fees are in US dollars unless otherwise specified

Client Responsibilities

To ensure successful project completion, clients agree to:

• Provide necessary content, images, and materials in a timely manner
• Respond to requests for feedback and approvals within reasonable timeframes
• Ensure all provided content is accurate and does not infringe on third-party rights
• Maintain backups of any original materials provided to us

Intellectual Property

Upon full payment, clients receive ownership of the final deliverables, including:

• Custom code written specifically for your project
• Design files and assets created for your project
• Content created on your behalf

We retain the right to use general techniques, knowledge, and non-proprietary components in future projects. Third-party assets (stock photos, fonts, plugins) are subject to their respective licenses.

Refunds and Cancellations

Our refund policy is as follows:

• Deposits are non-refundable once work has begun
• If you cancel before work begins, deposits are refundable minus any administrative fees
• Refunds for partially completed work are prorated based on work completed
• Monthly services can be cancelled with 30 days written notice

Limitation of Liability

To the maximum extent permitted by law, Borje Web Design shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.

Our total liability for any claim arising from our services shall not exceed the total amount paid by you for the specific service giving rise to the claim.

Website Hosting and Maintenance

For clients using our hosting and maintenance services:

• We strive for 99.9% uptime but do not guarantee uninterrupted service
• Regular backups are performed but clients should maintain their own backups
• We are not responsible for data loss due to circumstances beyond our control
• Maintenance includes security updates and minor fixes, not redesigns or new features

Acceptable Use

You agree not to use our services for any unlawful purpose or to:

• Distribute malware, spam, or harmful content
• Infringe on intellectual property rights
• Engage in fraudulent or deceptive practices
• Violate any applicable laws or regulations

Modifications to Terms

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting to our website. Continued use of our services after changes constitutes acceptance of the modified terms.

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Oregon, without regard to its conflict of law provisions.
